16.3 Class Action Waiver

YOU AND HANGRY JOE'S AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of class or representative proceeding.

16.4 Small Claims Court

Notwithstanding the foregoing, either party may bring an individual action in small claims court in the applicable jurisdiction, provided the claim qualifies and remains in such court.

TO THE EXTENT PERMITTED BY LAW, YOU HEREBY WAIVE YOUR CONSTITUTIONAL AND STATUTORY RIGHTS TO GO TO COURT AND HAVE A TRIAL IN FRONT OF A JUDGE OR JURY, INSTEAD ELECTING THAT ALL CLAIMS AND DISPUTES BE RESOLVED BY ARBITRATION AS SET FORTH IN THIS SECTION.
